We operate this website and our retail tasting bar locations, including all related information, content, features, tools, products, and services, in order to provide you with a curated wine shopping and tasting experience (the "Services").

The terms and conditions below, together with any policies referenced herein (these "Terms of Service" or "Terms"), describe your rights and responsibilities when you use the Services.

SECTION 1 – ACCESS AND ACCOUNT

By agreeing to these Terms of Service, you represent that you are at least 21 years of age, the minimum legal age to purchase alcohol, regardless of the age of majority in your state or province of residence. You may not allow minors to purchase or attempt to purchase alcohol through our Services.

To use the Services, including accessing or browsing our website or purchasing any products or services we offer, you may be asked to provide certain information such as your email address, billing, payment, and shipping information. You represent and warrant that all information you provide is accurate, current, and complete, and that you have all rights necessary to provide it.

You are solely responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You may not transfer, sell, assign, or license your account to any other person.


SECTION 2 – OUR PRODUCTS

We have made every effort to provide accurate representations of our products and services. However, please note that colors or product appearance may differ from how they appear on your screen due to your device type, settings, and configuration.

We do not warrant that the appearance or quality of any products purchased will meet your expectations or be identical to how they are depicted in our online store.

Please note that wine is an agricultural product and natural variation between vintages, producers, and individual bottles is expected. Tasting notes, scores, and descriptions are provided as a guide and may vary.

All product descriptions are subject to change at any time without notice at our sole discretion. We reserve the right to discontinue any product at any time and may limit quantities available to any person, geographic region, or jurisdiction on a case-by-case basis. Certain products may not be available for shipment to all states due to alcohol shipping regulations.


SECTION 3 – ORDERS

When you place an order, you are making an offer to purchase. Wine Stop Wine Shops & Tasting Bars reserves the right to accept or decline your order for any reason at its discretion. Your order is not accepted until we confirm acceptance. We must receive and process your payment before your order is accepted. Please review your order carefully before submitting, as we may be unable to accommodate cancellation requests after an order is accepted.

Orders for alcohol are subject to applicable state and local laws. We reserve the right to cancel any order destined for a state or jurisdiction where shipment of alcohol is prohibited, or where we are unable to verify that the recipient is 21 years of age or older. In such cases, a full refund will be issued.

In the event that we do not accept, modify, or cancel an order, we will attempt to notify you using the email, billing address, and/or phone number provided at the time the order was placed.

Your purchases are subject to return or exchange solely in accordance with our Refund Policy [LINK].

You represent and warrant that your purchases are for your own personal or household use and not for commercial resale or export. Resale of alcohol without the appropriate licenses is prohibited by law.


SECTION 4 – PRICES AND BILLING

Prices, discounts, and promotions are subject to change without notice. The price charged for a product or service will be the price in effect at the time the order is placed and will be set out in your order confirmation email. Unless otherwise expressly stated, posted prices do not include taxes, shipping, handling, or other applicable fees.

Please note that California wine purchases may be subject to a California Redemption Value (CRV) fee where applicable, which will be reflected at checkout.

Prices in our online store may differ from prices offered at our physical retail locations. We may offer promotions from time to time that affect pricing and are governed by separate terms. Where there is a conflict between promotion terms and these Terms, the promotion terms will govern.

You agree to provide current, complete, and accurate purchase, payment, and account information for all purchases. You agree to promptly update your account information, including email address, credit card numbers, and expiration dates, so that we can complete your transactions and contact you as needed.

You represent and warrant that (i) the payment information you provide is true, correct, and complete; (ii) you are duly authorized to use the payment method provided; (iii) charges incurred will be honored by your financial institution; and (iv) you will pay all charges at posted prices, including shipping, handling, and applicable taxes and fees.


SECTION 5 – SHIPPING AND DELIVERY

We are not liable for shipping and delivery delays. All delivery times are estimates only and are not guaranteed. We are not responsible for delays caused by shipping carriers, weather conditions, or events outside our control.

Alcohol Shipping Restrictions: The shipment of alcohol is regulated by state and federal law. We only ship to states where we are legally permitted to do so. It is your responsibility to confirm that wine shipments are lawful in your delivery location. Orders placed to restricted states will be cancelled and refunded. This list of eligible states is subject to change without notice.

Adult Signature Required: All alcohol shipments require a signature from an adult 21 years of age or older at the time of delivery. If no eligible adult is available to sign, the carrier will not leave the package. Redelivery attempts may result in additional fees. Wine Stop is not responsible for packages that cannot be delivered due to the unavailability of an adult recipient.

Temperature & Condition: We take care in packaging wine for shipment, but we are not responsible for damage caused by extreme weather conditions during transit. We recommend avoiding shipments during periods of extreme heat or cold.

Once we transfer products to the carrier, title and risk of loss passes to you.


SECTION 6 – INTELLECTUAL PROPERTY

Our Services, including but not limited to all trademarks, brands, text, displays, images, graphics, product reviews, video, and audio, and the design, selection, and arrangement thereof, are owned by Wine Stop Wine Shops & Tasting Bars, its affiliates, or licensors and are protected by U.S. and foreign patent, copyright, and other intellectual property laws.

These Terms permit you to use the Services for your personal, non-commercial use only. In the wine industry, vintages, allocations, and inventory can change rapidly. In the event that a specific vintage or product is no longer available after your order is placed, we will contact you to offer a suitable alternative or issue a full refund.
